Smart Coding, Sociedad Anónima de Capital Variable (the «Responsible Party»), with domicile at San Simón 34, Int 1, Col. San Simón Ticumac, CP. 03660, Alcaldía Benito Juarez, Mexico City, Mexico, in compliance with the Federal Law on the Protection of Personal Data in Possession of Individuals and its Regulations (hereinafter jointly referred to as the «Law»), makes available this Privacy Notice, so that you may know how your personal data and any information collected through different means including our website is used, disclosed and stored, in order to guarantee the privacy of such information and the right to self-determination of information of individuals. Likewise, we inform you of the purposes for which the Responsible Party collects and treats your Personal Data (as defined below).

The Responsible will collect the following personal data: Name, Paternal Surname, Maternal Surname, E-mail, Telephone (hereinafter, the «Personal Data»), necessary for the following purposes: Contact and commercial follow-up.

You have the right to access your Personal Data held by us and the details of their treatment, as well as to rectify them if they are inaccurate or incomplete, or to cancel them when you consider that they are not required for any of the purposes indicated in this Privacy Notice, or if they are being used for non-consensual purposes, or if the contractual or service relationship has ended, or to oppose the treatment of them for specific purposes (hereinafter, the «ARCO Rights»).

The request that you present for the exercise of the ARCO Rights will have to indicate your name and the address or e-mail in which you wish to receive all the information related to the procedure, besides being accompanied by the document or documents with which your identity or the personality of your legal representative is accredited. Likewise, we would appreciate it if you could include a clear and precise description of the data with respect to which you are seeking to exercise any of the ARCO Rights and any other element that would allow us to identify or locate the Personal Data in question. When it is a question of «rectification» of your Personal Data, you must also tell us what exact modification you are seeking to make and present the documentation that supports the request.

Additionally, for your protection and benefit, we may ask you for additional documentation that will allow us to fully identify the Personal Data you wish to access, rectify and/or cancel, or those regarding which you wish to oppose their treatment. The Person in Charge will try that the Personal Data contained in the databases are pertinent, correct and updated for the purposes for which they were obtained and when they have ceased to be necessary for the fulfillment of the foreseen purposes, they must be cancelled. Notwithstanding the foregoing, it is possible that the Person in Charge may not cancel or block your Personal Data in accordance with the provisions of the Law.

Once your complete and duly integrated request has been received, the Responsible Person will inform you of the corresponding response within a maximum period of 10 working days. If it is appropriate, within the following 15 working days you may exercise the right requested. In case the Responsible has to deliver the documents as a result of the right exercised, it will be done through copies that will be sent to you by e-mail or will be made available to you at the address that you indicate for this purpose, within the aforementioned period, so that you can pick them up directly or through a third party authorized by means of a power of attorney.

You may at any time revoke the consent you have given us to prevent the processing of your Personal Data in whole or in part, however, it is important to note that not in all cases we will be able to fulfill your request or conclude the use immediately, since it is possible that by some legal obligation the person in charge requires to continue processing your Personal Data. Likewise, you should consider that for certain purposes, the revocation of your consent will imply that we cannot continue providing you with the service and/or attention requested, or the conclusion of your relationship with the Responsible Party. In case you wish to revoke your consent to the processing of your Personal Data, you must submit your request to the Responsible Party accompanied by a copy of your official identification to prove that you are the owner of the Personal Data (if applicable, the authorization of your legal representative), and indicate the e-mail or address to which you wish to receive the information related to the procedure, a clear and precise description of the Personal Data regarding which you require to revoke your consent and the data that allow us to notify you of the resolution of your request. The Person in Charge will notify you of the resolution corresponding to your request within 10 working days following the presentation of your request, provided that it is complete and duly integrated.

In order that you can limit the use and disclosure of your personal information, you can register in the Public Registry to Avoid Advertising, which is in charge of the Federal Consumer Protection Office (PROFECO), so that your Personal Data will not be used to receive advertising or promotions. The Responsible, by means of the present Notice of Privacy, informs you that in its Internet page it uses cookies and/or other technologies through which it is possible to monitor your behavior as an Internet user, to provide you with a better service and user experience when navigating in our page, as well as to offer you new products and services based on your preferences.

At any time the Responsible Party may make modifications or updates to this Privacy Notice arising from new legal requirements, from the Responsible Party’s privacy policies or practices or from your needs arising from the products or services it offers, or for any other reason.
